CHICAGO (Legal Newsline) - Consumers have filed a class action lawsuit against Walgreen Co. and Walgreens Boot Alliance Inc. pharmacy, citing alleged fraud, negligent misrepresentation and unfair competition over inflated prescription drug costs.
Dorothy Forth, Troy Termine, Cynthia Russo and the International Brotherhood of Electrical Workers Local 38 Health and Welfare Fund filed a complaint on behalf of themselves and others similarly situated March 23 in the U.S. District Court for the Northern District of Illinois against the defendants, alleging they artificially inflated their prices for generic prescription drugs.
According to the complaint, Forth, Termine, Russo and the fund sustained damages from paying more for generic prescription drugs. The plaintiffs hold Walgreen Co. and Walgreens Boot Alliance Inc. responsible because the defendants allegedly reported artificially inflated customary prices for generics on claims submitted to third-party payers.
The plaintiffs request a trial by jury and seek permanent injunctive relief, compensatory, consequential, and general damages, disgorgement, restitution, profits, statutory treble damages, punitive or exemplary damages, court costs and any further relief the court grants.
