BROOKLYN, N.Y. (Legal Newsline) — A New York consumer has filed a class action lawsuit against Costco and a seafood business, alleging liability and negligent misrepresentation.

Ricarlos Guzman of Oceanside, New York, filed a complaint on behalf of all others similarly situated Feb. 27, in U.S. District Court for the Eastern District of New York against Trident Seafoods Corporation and Costco Wholesale Corporation, alleging they made false claims regarding the actual contents of their product.

According to the complaint, Guzman sustained monetary damages from being deceived into purchasing soft gel pills that was advertised to contain fish oil. The plaintiff alleges the defendants advertised their products to contain Omega fatty acids despite an independent lab test that shows the product does not contain the listed amount.

Guzman seeks trial by jury, all monies received by the defendant, restitution, disgorgement, monetary damages, court costs, interest, statutory or actual damages, injunctive relief against the defendant, punitive damages, and all relief the court grants. He is represented by attorney Michael J. Gabrielli of Gabrielli Levitt LLP in Bronx, New York.
