LOS ANGELES (Legal Newsline) — A man has filed a class-action lawsuit against Gold's Gym Southern California Group, citing alleged violation of telephone harassment statutes.
Wayne Hofstetter filed a complaint on behalf of all others similarly situated on Jan. 17 in the U.S. District Court for the Central District of California against Gold's Gym Southern California Group, alleging that the gym called his cellphone to solicit their services.
According to the complaint,
alleges that in September, he suffered damages from receiving unwanted calls and text messages to his cellphone. He holds Gold's Gym Southern California Group responsible because the company allegedly called him despite not receiving any prior consent to make those calls and text messages.
requests a trial by jury and seeks award $500 as statutory damages for each call, treble damages of $1,500 for each violation, injunctive relief and any further relief this court grants.
