Consumer sues Target over aloe vera gel

SACRAMENTO, Calif. (Legal Newsline) — A California consumer is suing Target, alleging fraudulent business practices and unjust enrichment.

Susan Nazari, of Sacramento, filed a class action lawsuit, individually and on behalf of all others similarly situated, Aug. 23 in U.S. District Court for the Eastern District of California against Target Corporation, alleging violation of California warranty and consumer protection laws.

According to the complaint, on July 2 Nazari purchased Up & Up Aloe Vera gel from a Target store in Sacramento. The suit says she relied on product labeling that the gel contains pure aloe vera when she made her purchase. The lawsuit states the gel does not contain this ingredient.

The lawsuit states Nazari was harmed financially and suffered actual damages for paying a premium for a product that was worth significantly less. The plaintiff alleges Target engaged in false, fraudulent, unfair, deceptive, and misleading marketing practices.

Nazari seeks trial by jury, an order to maintain this complaint as a class action and appointing the plaintiff as class representative and her attorney as class counsel, all damages, an order enjoining defendant from engaging in unfair business practices, pre- and post-judgment interest, attorney fees and costs, plus all relief the court deems proper.
