LOS ANGELES (Legal Newsline) - A consumer is suing the operator of a website that markets subscriptions for live answering services, alleging the defendant makes automatic renewals for its products without consumers' consent.

Kristyne Hanberg, individually and for all others similarly situated, filed a class action lawsuit April 1 in U.S. District Court for the Central District of California against Tresta Inc., doing business as and Does 1-10, alleging violations of California's Automatic Renewal Law and the state's Unfair Competition Law.

The suit alleges the defendants made automatic renewal or continuous service offers to consumers but failed to present the offers' terms in a clear and conspicuous manner and charged credit and debit cards and third party accounts without first obtaining consumers' affirmative consent.  

The complaint states the defendants also failed to provide an acknowledgement that provides the offer terms, cancellation policy and information regarding how to cancel.


Hanberg and others in the class seek damages, restitution, declaratory and injunctive relief, plus attorney fees and costs. They are represented by attorneys Scott J. Ferrell, Richard H. Hikida, David W. Reid, and Victoria C. Knowles of Newport Trial Group in Newport Beach, California.
