NEW YORK (Legal Newsline) - The maker of a dietary weight loss supplement is being sued over allegations that its product doesn't cause users to lose significant weight.
Adelaide Spence filed the lawsuit on June 24 in the U.S. District Court for the Southern District of New York against Basic Research, the maker of the Vysera-CLS supplement.
Basic Research advertises the supplement as a “miracle pill” and “the amazing cupcake diet,” the lawsuit states. The company claims the pill blocks carbohydrates, and that users can eat “a whole donut, but only absorb a fraction of the calories.”
Users were told they would lose a significant amount of weight while on the pill without have to follow a diet or workout. However, those claims aren't true, the lawsuit alleges.
“Scientific knowledge has long demonstrated that substantial weight loss through mal-absorption of calories along without diet and exercise... is not scientifically feasible,” the lawsuit states.
The lawsuit is seeking class status for those who purchased the diet pill. The plaintiff is seeking damages in excess of $5 million plus court costs.
