CONCORD, N.H. (Legal Newsline) - A Missouri-based company that specializes in plasma cutting has quickly settled allegations that it violated hazardous waste laws at its New Hampshire facility.
New Hampshire Attorney General Kelly Ayotte said Monday that Thermal Dynamics Corp. will pay $281,500 to end the State's suit, filed March 24 in Grafton County Superior Court.
"This settlement reflects the State's efforts to ensure that companies operating in New Hampshire comply with hazardous waste laws that protect public health and the environment, while also encouraging waste reduction projects," Ayotte said.
TDC will pay $157,445 to the State's Hazardous Waste Cleanup Fund and $124,055 will be spent on pollution control equipment at the company's facility, located in West Lebanon, over the next nine months.
The company admitted no fault but said it did not want to fight the suit. The State alleged 72 violations of hazardous waste laws
"TDC does not admit, and nothing in this agreement or its performance constitutes or should be interpreted as an admission of any facts or legal allegations in the Petition," the consent decree says.
"Nothing herein shall be construed as an admission of fact or liability by TDC. The State and TDC, wishing to avoid the expense of litigation, agree without adjudication of the facts or law, that settlement of this matter is in the public interest and that entry of this Decree without further litigation is an appropriate way to resolve any dispute..."
