Doctor alleges Montefiore Health System retaliated against him over fraud complaints

NEW YORK (Legal Newsline) – A doctor alleges he was compelled to resign his position because of retaliation over his complaints of alleged fraud and patient harm and abuse.

Dr. Dan Giurca filed a complaint on Dec. 10 in the U.S. District Court for the Southern District of New York against Montefiore Health System Inc., Dr. Jeffrey Weiss, Dr. Claus Von Schorn, and Dr. Gary Ishkanian citing the federal and New York False Claims Acts and other counts.

According to the complaint, the plaintiff alleges that on March 30, 2014, he informed the defendants about alleged patient abuse and Medicaid/Medicare billing fraud. He alleges in response, he was subjected to discrimination, intimidation, coercion and retaliation by the defendants to "silence" him. He alleges he was compelled to resign.

The plaintiff holds Montefiore Health System Inc., Weiss, Von Schorn and Ishkanian responsible because the defendants allegedly intentionally retaliated against him.

The plaintiff requests a trial by jury and seeks judgment against defendants, injunctive relief, costs, attorney’s fees, and further relief as is proper. He is represented by Robert W. Sadowski of Sadowski Katz LLP in New York.
