Former AFSCME union member alleges dues violated rights

MINNEAPOLIS (Legal Newsline) – A former union member alleges that her rights were violated because she was compelled to pay money to the union as a condition of her employment.

Jayme Prokes filed a complaint on behalf of herself and others similarly situated on Aug. 14 in the U.S. District Court for the District of Minnesota against American Federation of State, County and Municipal Employees, Council No. 5 alleging unconstitutional garnishment of wages.

According to the complaint, the plaintiff is a former member of the American Federation of State, County and Municipal Employees Council No. 5 and she alleges she was compelled to pay money to the union as a condition of her employment. She alleges the union continues to take dues from her pay even after she resigned her membership and instructed it to terminate all payroll deductions.

The plaintiffs request a trial by jury and seek judgment against defendant, certify class action, declaratory relief, award costs and attorneys’ fees, and all other relief that the court may deem just. She is represented by Jonathan F. Mitchell of Mitchell Law PLLC in Austin, Texas and Douglas P. Seaton of Seaton, Peters & Revnew PA in Minneapolis, Minnesota.
