Good Health snack products alleged to misrepresent nutritional, health qualities

NEW YORK (Legal Newsline) – A New York man alleges a line of snack food products is deceptively labeled and marketed.

David Feldman, on behalf of himself and all others similarly situated, filed a complaint on July 2 in the U.S. District Court for the Southern District of New York against UTZ Quality Foods LLC; Good Health Natural Products Inc.; Good Health Natural Products LLC; PAT Posts 1-10 and ABC Corps. 1-10 alleging breach of express warranty, unjust enrichment and other counts.

According to the complaint, the plaintiff alleges the defendants misrepresent the vegetable content and nutritional and health qualities of the Good Health Extra Goodness products.

"...Although defendants market their products as healthful and nutritious, these products are devoid of the health benefits plaintiff and other reasonable consumers associate with consuming real vegetables," the suit states.

The plaintiff holds the defendants responsible because the defendants allegedly breached their express warranty by selling products that do not conform to the warranties made and misrepresented the characteristics, ingredients and benefits of the products.

The plaintiff requests a trial by jury and seeks compensatory, treble and punitive damages; prejudgment interest; injunctive relief; attorneys' fees; expenses and costs of suit. He is represented by Joshua S. Bauchner and Michael H. Ansell of Ansell Grimm & Aaron PC in Woodland Park, New Jersey.
