Netgear Inc. named in suit over deletion of files from ReadyNAS devices

SAN FRANCISCO – A class-action suit has been filed against a computer networking company over the deletion of files from network attached storage devices.

Michel Sassine, individually and on behalf of all others similarly situated, filed a complaint on March 23 in the U.S. District Court for the Northern District of California, San Francisco Division against Netgear Inc. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that in March 2015, he purchased a Netgear ReadyNAS RN104 and uploaded approximately five terabytes of his files to the device, which included family photos, videos and writing projects from college. He alleges all of the files on his ReadyNAS were deleted by Netgear in March 2017 because of a deletion command that affected several customers' data.

The plaintiff holds Netgear Inc. responsible because the defendant allegedly failed to perform its obligations under the contract because the ReadyNAS device failed to store and protect files.

The plaintiff requests a trial by jury and seeks award of damages, injunctive and other equitable relief as necessary, litigation expenses and attorneys’ fees, pre- and post-judgment interest and such other and further relief as equity and justice may require.
