Consumer claims Olympia beer's 'It's the Water' slogan is false advertising

SACRAMENTO, Calif. (Legal Newsline) – A plaintiff described in his suit as a beer and craft beer consumer alleges Pabst Brewing Co. is using false advertising with the marketing of its Olympia-brand beer.

Brendan Peacock filed a complaint on behalf of himself and all others similarly situated on March 15 in the U.S. District Court for the Eastern District of California against Pabst Brewing Co. LLC alleging violation of the California Unfair Competition Law.

According to the complaint, the plaintiff alleges that he and other consumers have suffered injury in fact and lost money or property as a result of defendant’s false and misleading advertising tactics to market and sell its Olympia beer product with the “It’s the Water” slogan. The plaintiff alleges the beer is no longer brewed with the Washington state artesian water for which it was famed but instead brewed in a mass-production facility in Los Angeles County.

The plaintiff holds Pabst Brewing Co. LLC responsible because the defendant allegedly created the impression that its beer was being brewed using artesian waters and denied consumers the benefit of the bargain in purchasing premium-priced beer.

The plaintiff requests a trial by jury and seeks judgment and relief against defendant, certification of the class, appoint plaintiff as class representative and his attorneys as class counsel, corrective advertising and information campaign, restitution, disgorge all monies wrongfully obtained, award damages, and further relief as may be just.
