ApplicantPro alleged to have invaded man's privacy with text messages

MIAMI (Legal Newsline) – A Palm Beach County, Florida individual alleges that his privacy was invaded by telemarketing texts from a Utah company.

Richard Marous, individually and on behalf of all others similarly situated, filed a complaint on Feb. 16 in the U.S. District Court for the Southern District of Florida against Jobmatch LLC, doing business as ApplicantPro, over alleged violation of the Telephone Consumer Protection Act.

According to the complaint, Marous alleges that between April 24 and July 8, 2017, he received telemarketing text messages from defendant through the using of an automatic telephone dialing system. He alleges that he did not give the defendant his express consent to receive text messages.

The plaintiff holds Jobmatch LLC responsible because the defendant's text messages allegedly damaged him by invaded his privacy and causing him aggravation and annoyance.

The plaintiff requests a trial by jury and seeks injunction prohibiting the defendant from using an automatic telephone dialing system, award of actual and statutory damages, and such further and other relief the court deems reasonable and just. He is represented by Andrew J. Shamis of Shamis & Gentile PA in Miami.
