Nonprofit claims 'all-natural' labels on some Bigelow brand teas are false, misleading

WASHINGTON (Legal Newsline) – A nonprofit advocacy group is suing a tea company over allegations the all-natural labeling on some of its products is misleading.

Organic Consumers Association filed a complaint on Jan. 12 in the Superior Court of the District of Columbia against R.C. Bigelow Inc. for alleged violation of the Columbia Consumer Protection Procedures Act.

According to the complaint, the plaintiff alleges that on Oct. 4, 2017, it purchased defendant's Bigelow Classic Green Tea at a Walmart in order to evaluate its purported qualities as an “all-natural” and environmentally friendly product. The plaintiff claims the all-natural claims are false and misleading because the products contain synthetic chemical glyphosate.

The plaintiff holds R.C. Bigelow Inc. responsible because the defendant's all-natural labeling of its products misleads and omits facts regarding the source, quality and grade of its products.

The plaintiff requests a trial by jury and seeks costs, disbursements, including reasonable attorneys' fees, and expert fees, prejudgment interest, and such further relief, including equitable relief, as the court may deem just and proper. It is represented by Kim E. Richman of Richman Law Group in Brooklyn, New York.
