Massachusetts law firm alleges competitors put up similar billboard

BOSTON (Legal Newsline) – A Massachusetts personal injury law firm alleges that two other competing law firms in the state put up a confusingly similar billboard.

Ellis Law Offices LLP filed a complaint on Nov. 13 in the Superior Court of the Commonwealth of Massachusetts against The Law Offices of Joseph J. Cariglia PC and Murray Marketing Inc. alleging trade dress infringement and other counts.

According to the complaint, the plaintiff alleges that in June, it had a billboard posted in the state with a blue and yellow color scheme with the words "Injured? Results you deserve." It alleges on Oct. 3, the defendants put up a similar billboard with the words "Injured? Don't stand alone."

The plaintiff holds The Law Offices of Joseph J. Cariglia PC and Murray Marketing Inc. responsible because the defendants allegedly are likely to cause confusion among consumers as to the source of the legal services advertised.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, along with costs and interest. It is represented by Robert A. Riordan Jr. of Ellis Law Offices LLP in Worcester, Massachusetts.

The defendants removed the case to the U.S. District Court for the District of Massachusetts on Nov. 21.
