Cascade Collections alleged to have violated collection laws with letter

NEW YORK (Legal Newsline) – A New York consumer alleges a debt collection letter she received is unlawful.

Assana Lloyd filed a complaint individually and on behalf of all others similarly situated on Oct. 26 in the U.S. District Court for the Southern District of New York against Cascade Collections Inc. alleging violation of the Fair Debt Collections Practices Act.

According to the complaint, Bookbyte.com contracted the defendant to collect an alleged debt from the plaintiff. On July 10, the suit states that the defendant sent plaintiff a collection letter that fails to state that the interest, fees and costs are continuously accruing. She also alleges that the letter uses confusing language.

The plaintiffs hold Cascade Collections Inc. responsible because the defendant allegedly made false and misleading representation in violation of the FDCPA.

The plaintiffs seek judgment against defendant for statutory and actual damages, attorney's fees and expenses and further relief as the court may deem just. She is represented by Daniel Kohn of RC Law Group PLLC in Hackensack, New Jersey.
