Chicago firm sues loan companies over unsolicited faxes

CHICAGO (Legal Newsline) — A professional corporation has filed a class action lawsuit against loan service companies, alleging that it was sent unsolicited faxes in violation of telephone harassment statutes.

Grazian & Volpe PC, on behalf of itself and the class members similarly situated, filed a complaint on Oct. 16 in the U.S. District Court for the Northern District of Illinois Eastern Division against Fair Rate Legal Funding Partnership; Amex Legal Funding LLC; and others for alleged violation of the Telephone Consumer Protection Act (TCPA).

According to the complaint, the plaintiff alleges that, in 2016, the company received unsolicited fax advertisements on its facsimile machine from the defendants, offering its products and services. The plaintiff claims it had no prior relationship with defendants and had not authorized the sending of the fax advertisements. As a result, the plaintiff and each class member suffered damages in the form of excessive use of paper and ink or toner. 

The plaintiff alleges the defendants engaged in a pattern of sending unsolicited advertisements to fax machines, violating the TCPA.

The plaintiff requests a trial by jury and seeks judgment for appropriate damages, injunction against the further transmission of unsolicited fax advertisements, costs of suit and such other relief as the court deems proper.
