Law Offices of Timothy Carl Blake seeks damages over fax that allegedly did not contain opt-out notice

MIAMI (Legal Newsline) – A Miami law firm alleges that a copy machine business sent it an unsolicited fax.

Law Offices of Timothy Carl Blake PA, individually and on behalf of all others similarly situated, filed a complaint on Oct. 6 in the U.S. District Court for the Southern District of Florida, Miami Division against JCM Distributors LLC, doing business as JCM Copiers, alleging violation of Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on Sept. 19, it received a facsimile advertisement from the defendant promoting its products and services. The plaintiff claims the defendant's fax did not contain an opt-out notice stating that the recipient may make a request to the sender not to send any future faxes as required by the TCPA.

The plaintiffs request a trial by jury and seek award for statutory damages of $1,500 for each unsolicited fax, penalties, interest and costs, attorneys' fees and granting supplemental equitable relief as may be appropriate.
