RICHMOND, Va. (Legal Newsline) – A Virginia dentist alleges his practice has suffered because of a volunteer clinic in the area.

Dr. Mark G. Turner, DDS, PC and Dr. Mark G. Turner, DDS filed a complaint on July 26 in the U.S. District Court for the Eastern District of Virginia against Virginia Department of Medical Assistance Services; DentaQuest LLC; Dr. David Black, DDS; Dr. Terry Dickinson, DDS; Dr. Greg Harvey, DDS; Dr. Tonya Parris-Wilkins, DDS; John Doe Number 1; Jane Doe Number 1; and Jane Doe Number 2 alleging violation of the Sherman Act.

According to the complaint, the plaintiff entered into an agreement with the predecessor of DentaQuest in 2007 to provide Medicaid-approved dental services through the Smiles for Children program.

The suit states that a free, traveling dental clinic in the Roanoke, Virginia, area called the Mission of Mercy Clinic had "a significant negative impact" on the plaintiff's business because he was "competing against volunteer dentists who were treating oral surgery patients who had a 100 percent Medicaid benefit." He alleges that the defendant dentists "joined together" to keep him from competing against them.

The plaintiffs request a trial by jury and seek enjoin the defendants, all legal fees, interest and any other relief as the court deems just. He is represented by Vincent M. Amberly of Amberly Law in Leesburg, Virginia.
