City Club of New York seeks to nullify permit modification for Pier 55 project

WHITE PLAINS, N.Y. (Legal Newsline) – A nonprofit corporation alleges that a permit issued for a pier project in New York is unlawful.

The City Club of New York, Robert Buchanan and Tom Fox filed a complaint on July 21 in the U.S. District Court for the Southern District of New York against U.S. Army Corps of Engineers, Hudson River Park Trust and Pier55 Inc. citing the New York State Environmental Quality Review Act and other counts.

According to the complaint, the plaintiffs allege that the U.S. Army Corp of Engineers issued a new permit modification to the Hudson River Park Trust for its Pier 55 island project that is unlawful. They allege that the Corps approved the project without considering the load-bearing capacity of Pier 54 and the potential to subject the Estaurine Sanctuary to unnecessary in-water development.

The plaintiffs seek nullifying, vacating, and setting aside Permit Modification NAN-1998-00290-M16 on May 29, 2015, enjoin the defendants, all legal fees and any other relief as this court deems just. They are represented by Richard D. Emery, Elizabeth S. Saylor and Douglas E. Lieb of Emery Celli Brinckerhoff & Abady LLP in New York.
