Woman files suit against Petland, others after puppy allegedly dies from parvovirus

ATLANTA (Legal Newsline) – A consumer alleges a pet store chain misrepresents the health of its animals.

Rosalba Cisneros filed a complaint on behalf of herself and all others similarly situated on July 26 in the U.S. District Court for the Northern District of Georgia against Petland Inc., BKG Pets Inc., Pets BKG LLC and PAWSitive Solutions Inc. citing the Racketeer Influence and Corrupt Organizations Act.

According to the complaint, the plaintiff purchased a shih tzu puppy in December 2015 for $2,400 from Petland Kennesaw. The suit states the puppy was diagnosed with parvovirus the day after purchase and died a few days later. The plaintiff alleges that she suffered damages from being misled into purchasing an animal that she believed was healthy. 

The plaintiff holds Petland Inc., BKG Pets Inc., Pets BKG LLC and PAWSitive Solutions Inc. responsible because the defendants allegedly misrepresents the health condition of the puppies they are selling through the use of false veterinary certification in order to mislead consumers into buying them.

The plaintiff requests a trial by jury and seeks compensatory and actual damages, restitution and disgorgement, incidental and consequential damages, enjoin the defendants, treble damages, punitive damages, all legal fees and any other relief as the court deems just. She is represented by Michael I. Fistel Jr., William W. Stone and David Weisz of Johnson & Weaver LLP in Marietta, Georgia.
