Advocates sue FDA over Nutrition Labeling Rule

WASHINGTON (Legal Newsline) — Two advocacy groups are suing the FDA and government officials, alleging violation of federal law.

The Center for Science in the Public Interest and National Consumers League filed a complaint June 7 in U.S. District Court for the District of Columbia against Health and Human Services Secretary Tom Price, FDA Commissioner Scott Gottlieb, and the U.S. Food and Drug Administration, alleging they delayed the enactment of the Nutrition Labeling Rule.

According to the complaint, the plaintiffs suffered damages on behalf of the public because the defendants failed to perform their duties, causing delays in the compliance deadline of a prior rule, the Nutrition Labeling Rule.

The plaintiffs seek vacating the delay rule, declare compliance with the Nutrition Labeling Rule is required by a certain date not to exceed 15 days after the order is issued, all legal fees, and all other relief as this court deems just. They are represented by attorney Seth L. Johnson of Earthjustice in Washington.
