Vitamin Shoppe sued over muscle-building supplement

BOSTON (Legal Newsline) - A consumer has filed a class action lawsuit against New Jersey-based Vitamin Shoppe Inc., citing alleged negligent misrepresentation of its glutamine products.

Richard Ferrari filed a complaint on behalf of himself and all others similarly situated March 21 in the U.S. District Court for the District of Massachusetts against Vitamin Shoppe. He alleges the company made false claims regarding the benefits of its muscle-growth product.

According to the complaint, the plaintiff alleges he was damaged from purchasing a product that has no health benefits. He holds Vitamin Shoppe responsible because the company allegedly misleads consumers through its product labels, which say the product can provide recovery from exercise and promotes the recovery of muscle tissue.

The plaintiff requests a trial by jury and seeks economic and compensatory damages, actual damages, treble damages, all other damages, injunctive relief, court costs and any further relief the court grants.
