SANTA ANA, Calif. (Legal Newsline) — A consumer has filed a class action lawsuit against the maker of an almond milk product, alleging the beverage was misleadingly marketed as nondairy drink with the same nutrition as cow's milk.

Melissa Cuevas of Colton, Calif., filed a complaint on behalf of similarly situated individuals on March 13, in the U.S. District Court for the Central District of California against TopCo Associates LLC, alleging that the California business falsely advertises the nutritional facts of its Full Circle Almondmilk product.

According to the complaint, the plaintiff alleges that she sustained damages from being misled into purchasing a falsely advertised product. The plaintiff holds TopCo Associates responsible because the defendant allegedly made false claims that its almond milk product is an alternative for dairy milk and just as nutritious as real milk - despite lacking many essential nutrients and vitamins.

The plaintiff requests a trial by jury and seeks enjoin the defendant. She also seeks an injunction against the defendant, disgorgement, restitution, court costs, interest and any further relief the court grants. She is represented by Lee Cirsch, Robert Friedl and Trisha Monesi of Capstone Law APC in Los Angeles.
