Property owners accuse Texas corporation of negligent misrepresentation

DENVER (Legal Newsline) — Four property owners are suing a Texas business and its officers, alleging fraud, negligent misrepresentation and tortious interference.

Jane Wilner, Trudo Letschert, Robert Rudnick and Russell Schmeiser filed a class action complaint, individually and on behalf of all others similarly situated, Dec. 7 in the U.S. District Court for the District of Colorado against Behringer Harvard Cordillera, LLC, Behringer Harvard Holdings, LLC, Robert M. Behringer, Michael D. Cohen, and CCG Management, LLC, alleging they made false representations regarding the proposed modifications to a planned resort community.

According to the complaint, the plaintiffs suffered monetary damages the result of the fraudulent concealment of the modification of the 10th Cordillera PUD community in Edwards, Colorado. The plaintiffs allege the defendants made false representations in order for the plaintiffs to approve the 2009 proposed modification.

The plaintiffs seek trial by jury, compensatory damages of more than $100,000,000, declare the 2009 proposed modification to the 10th Cordillera PUD null, void and invalid, injunction against the defendants, court costs and any further relief the court grants. They are represented by attorneys Paul J. Lopach and Desmonne A. Bennett of Bryan Cave LLP in Denver.
