CHICAGO (Legal Newsline) – An Illinois consumer has filed a class action lawsuit against a supplement maker alleging a specific type of supplement is falsely advertised.
Sean Wagner filed a complaint on behalf of all others similarly situated on Nov. 30 in the U.S. District Court for the Northern District of Illinois, Eastern Division against General Nutrition Corp. alleging unjust enrichment, violation of the Illinois Consumer Fraud and Deceptive Business Practices Act and other counts.
According to the complaint, the plaintiff alleges that the defendant's L-Glutamine dietary supplements are advertised as having anti-catabolic effects and that they are beneficial for the support of muscle function and faster workout recovery. The plaintiff holds General Nutrition Corp. responsible because the defendant allegedly falsely advertised the supplements as being beneficial when they are ineffective.
The plaintiff requests a trial by jury and seeks enjoin the defendant, restitution, disgorgement, actual damages, punitive damages, statutory damages, all legal fees and interest plus any other relief as the court deems just.
