TAMPA, Fla. (Legal Newsline) – A consumer has filed a class action lawsuit against a gas station chain over allegations that it made unauthorized charges to customers' debit or credit cards at point-of-sale gasoline pumps.

Kara Teggerdine filed a complaint on behalf of all others similarly situated on Nov. 28 in the U.S. District Court for the Middle District of Florida against Speedway LLC alleging negligence, breach of implied contract and other counts.

According to the complaint, the plaintiff alleges that she suffered financial damages from being charged an additional $125 authorization hold for a $5.01 purchase of gas in November. The plaintiff holds Speedway LLC responsible because the defendant allegedly failed to disclose to consumers the additional $125 authorization hold when using a debit/check card and for not releasing the hold in two hours as the defendant's representatives had promised.

The plaintiff requests a trial by jury and seeks enjoin the defendant, restitution, disgorgement, actual and compensatory damages, all legal fees and any other relief as the court deems just.
