CHICAGO (Legal Newsline) — An Illinois man is suing a Florida health and fitness business, alleging breach of implied warranty and negligent misrepresentation.

John M. Ulrich of Chicago filed a class action complaint, individually and on behalf of all others similarly situated, Nov. 10 in U.S. District Court for the Northern District of Illinois against Probalance, Inc. alleging the defendant made false claims regarding its product.

According to the complaint, Ulrich suffered monetary damages from purchasing a falsely advertised liquid protein product. The plaintiff alleges Probalance falsely advertises the protein content and daily value percentage of its product to consumers.

Ulrich seeks trial by jury, enjoining the defendant, restitution, disgorgement, compensatory and punitive damages, actual and statutory damages, all legal fees and any other relief the court deems just. He is represented by attorney Nick Suciu III of Barbat, Mansour & Suciu PLLC in Bloomfield Hills, Michigan.
