LOS ANGELES (Legal Newsline) — A Los Angeles consumer is suing a Canadian corporation, alleging breach of implied warranty.
Arthur Martinez-Leander filed a class action complaint, individually and on behalf of all others similarly situated and the general public Nov. 3 in U.S. District Court for the Central District of California against
Wellnx Life Sciences Inc., and Platinum US Distribution, Inc. doing business as Wellnx Life Sciences USA,
alleging that they made false claims regarding their product.
According to the complaint, Martinez-Lender suffered monetary damages from purchasing a falsely advertised product. The plaintiff alleges the defendants say their product could help customers lose weight despite containing the active ingredient hydroxycitric acid which provides no such benefit.
Martinez-Leander seeks trial by jury, an order for the defendant to participate in corrective advertising, an order for the defendant to destroy all misleading and deceptive advertising materials, disgorgement, restitution, actual and punitive damages to the plaintiff, court costs and any further relief the court grants.
