LOS ANGELES (Legal Newsline) — Consumers have filed a class-action lawsuit against Johnson & Johnson, McNeil-PPC, Inc., Johnson & Johnson Consumer, Inc., and Ranir LLC, New Jersey corporation, citing alleged negligent misrepresentation.
Melanie Barber, Ki Burke and Joseph Gregorio filed a complaint on behalf of all others similarly situated on Oct. 26, in the U.S. District Court for the Central District of California against the defendants alleging that they made false claims regarding their product.
According to the complaint, the plaintiffs allege that Melanie Barber, Ki Burke and Joseph Gregorio suffered damages from being misled into purchasing products that don't work as well as advertised. The plaintiffs holds Johnson & Johnson, McNeil-PPC, Inc., Johnson & Johnson Consumer, Inc., and Ranir LLC responsible because the defendants allegedly made false claims that their product could provide whiter teeth in order to sell it at a premium price.
The plaintiffs request a trial by jury and seek compensatory and punitive damages, injuncive relief, restitution and disgorgement, all legal fees and any other relief as this court deems just. They are represented by L. Timothy Fisher and Annick M. Persinger of Bursor & Fisher, P.A. in Walnut Creek, California and Antonio Vozzolo of Vozzolo LLC in Upper Saddle River, New Jersey.
