SAN FRANCISCO (Legal Newsline) — A California man is suing United Parcel Service, alleging fraud, negligent misrepresentation and unjust enrichment.

Randall Holl of Sonoma County, California,  filed a class action complaint, individually and on behalf of others similarly situated, Oct. 11 in U.S. District Court for the Northern District of California against United Parcel Service Inc. alleging UPS overcharges customer by charging them a “delivery area surcharge”.

According to the complaint, Holl suffered monetary damages from being overcharged. The plaintiff alleges UPS overcharges customers through inflated delivery area surcharge rates depending if the customer has an account with UPS.

Holl seeks economic damages, restitution, treble damages, all legal fees and interest and any other relief the court deems just. He is represented by attorneys Matthew C. Helland of Nichols Kaster LLP in San Francisco, and by Adam W. Hansen of Apollo Law LLC in Minneapolis.
