Customer accuses Illinois business of false advertising

CHICAGO (Legal Newsline) — A Pennsylvania man is suing an Illinois business, alleging false claims on the size of a storage shed. 

Anthony Succi of Perkasie, Pennsylvania, filed a class action lawsuit, individually and on behalf of all others similarly situated, June 24 in U.S. District Court for the Northern District of Illinois against Suncast Corporation of Batavia, alleging breach of warranty, fraud, negligent misrepresentation and unjust enrichment.

According to the complaint, Succi suffered financial damages after purchasing, for $1,270.94, a falsely advertised storage shed. The plaintiff alleges Suncast made false claims regarding the actual size and storage capacity of its shed.

For instance, the suit says, one shed is advertised at having a width of 7 feet 5 3/4 inches when it is actually 6 feet 10 inches.

Succi seeks trial by jury, enjoining the defendant from making false representations, actual damages, all legal fees and all other relief the court deems just. He is represented by attorneys Katrina Carroll and Kyle A. Shamberg of Lite Depalma Greenberg LLC in Chicago, and by Joseph G. Sauder, Matthew D. Schelkopf and Joseph B. Kenney of McCuneWright LLP in Berwyn, Pennsylvania.
