BROOKLYN (Legal Newsline) — A New York woman is suing a manufacturer of drink tablet products, alleging false advertising.
Consumers have filed a class-action lawsuit against Nuun & Company Inc., a manufacturer, citing alleged false advertising.
Jutamat Riedel and John Does 1-10 filed a class action lawsuit, on behalf of themselves and for others similarly situated July 29 in U.S. District Court for the Eastern District of New York against Nuun & Company Inc. alleging unfair, deceptive and fraudulent trade and business practices.
According to the complaint, Riedel, John Does 1-10 and others purchased Nuun's electrolyte-enhanced drink tablet products in non-transparent wrappings. The suit says the product contained a non-functional slack-fill mechanism that made it appear as though the plaintiffs and class members were buying a larger amount than what actually is being sold.
The plaintiffs allege Nuun & Company sold its products with a mechanism that was designed to deceive consumers as to the product's true volume, was unjustly enriched as a result of its unlawful conduct and misled the reasonable consumer into purchasing the product.
The plaintiffs seek a trial by jury, damages, interest, injunctive relief to repackage the products, attorney fees and legal expenses, costs of suit and other relief the court deems just. They are represented by attorneys C.K. Lee and Anne Seelig of Lee Litigation Group PLLC in New York.
