LITTLE ROCK (Legal Newsline) — A Pope County man is suing Yeti cooler sellers, alleging breach of warranty and unconscionable, false or deceptive practices.

James Moore of Russelville, Arkansas, filed a lawsuit, individually and on behalf of all similarly situated persons, July 26, in Circuit Court of Pope County, Arkansas Civil Division 4 against Mack's Sport Shop LLP doing business as Mack's Prairie Wings LLP and Yeti Coolers LLC, alleging that they violated the Uniform Commercial Code and the Arkansas Deceptive Trade Practices Act.

According to the complaint, on Oct. 21, 2014, Moore ordered a Yeti 45-quart Tundra cooler and paid $386.74. The suit says Moore later learned the cooler was only 37.6 quarts. 

The lawsuit states he suffered an ascertainable loss of money for paying more for a Yeti cooler that actually costs less. The plaintiff alleges the defendants misrepresented the actual volume of the Yeti coolers, deceptively advertised and sold Yeti coolers as containing more volume than they actually contain.

Moore seeks a trial by jury, an order certifying this case as a class action, compensatory damages, attorney fees and legal costs, pre-and post-judgment interest and such relief as the court deems proper. No attorney is listed in the complaint.
