Time Inc., others allegedly deceived consumers into agreeing to automatic renewal subscriptions

SAN DIEGO (Legal Newsline) — Consumers have filed a class action lawsuit against a magazine subscription program provider after the provider allegedly renewed subscriptions automatically without permission.

Shannon Dale Prince and Cheryl Edgemon filed a complaint on behalf of themselves and all others similarly situated on May 17 in the Superior Court of the State of California, San Diego County, against Synapse Group Inc., Synapseconnect Inc., Time Inc., and Does 1-50, alleging that they deceived consumers into obtaining their magazines for free.

According to the complaint, the plaintiffs allege that in February 2014, Shannon Dale Prince and Cheryl Edgemon suffered damages as the result of being subscribed to a program that automatically renews subscriptions every year. The plaintiffs hold Synapse Group Inc., Synapseconnect Inc., Time Inc., and Does 1-50 responsible because the defendants allegedly deceived consumers into obtaining free issues of their magazine or purchasing them at a discounted price without informing them about the automatic yearly renewal.

The defendant removed the case to U.S. District Court for the Southern District of California on June 17.

The plaintiffs request a trial by jury and seek restitution, injunctive relief, damages in an amount to be proven in trial, punitive damages, all legal fees and interest, and any other relief as the court deems just. They are represented by James T. Hannink and Zach P. Dostart of Dostart Hannink & Coveney LLP in La Jolla, California.
