DENVER (Legal Newsline) — A Colorado couple are suing a solar company and a financing firm, alleging improper agreements.
Jason Terlizzi and Rebecca Terlizzi filed a class action complaint, individually and on behalf of all others similarly situated, July 5 in U.S. District Court for the District of Colorado against
Altitude Marketing Inc, doing business as 1800 Solar USA, and GreenSky LLC, alleging violation of the Colorado’s Uniform Consumer Credit Code.
According to the complaint, the plaintiffs suffered damages of more than $49,000 of debt for a solar energy system that does not work as promised. The plaintiffs allege the defendants generated unlicensed and predatory consumer loans through deceptive in-home sales of defective products, and failed to include the notice of cancellation forms required for home solicitations.
The Terlizzis seek trial by jury, declaratory relief as well as statutory damages of three times the amount of the finance charges imposed upon them, plus court costs and reasonable attorney fees.
