SAN FRANCISCO (Legal Newsline) – Two individuals have filed a class-action lawsuit against several department stories alleging that they made false representations on the prices of their products.
Job Carder and Erica Vinci filed a complaint on behalf of all others similarly situated on June 15 in the U.S. District Court for the Northern District of California against Macy's West Stores Inc., Macy's Inc. and Bloomingdale's Inc. alleging unfair business practices, fraudulent business practices, false advertising and other counts.
According to the complaint, the plaintiffs allege that they were misled into purchasing products that they believed to be discounted, but were actually marked at the original manufacturer's suggested retail price. The plaintiffs hold Macy's West Stores Inc., Macy's Inc. and Bloomingdale's Inc. responsible because the defendants allegedly artificially inflated the prices of their goods to make it seem like consumers were getting a big discount.
The plaintiffs request a trial by jury and seek all damages, restitution, disgorgement, court costs, prejudgment interest and any further relief the court grants. They are represented by Michael C. Martinez and Mark Charles of Martinez Charles LLP in Pasadena, California.
