California consumer sues Kidfresh for allegedly misrepresenting its frozen food items

NEW YORK (Legal Newsline) - A California resident is suing a frozen foods company, alleging it misrepresents its products as being healthy.

Ki Burke of San Pedro, California, individually and for all others similarly situated, filed a class action lawsuit April 21 in the U.S. District Court for the Southern District of New York against MG Wellington LLC, doing business as Kidfresh, alleging violations of the New York General Business Law, violations of California business and civil codes, intentional and negligent misrepresentation, breach of express and implied warranties, and unjust enrichment.

The suit alleges Kidfresh misleadingly markets high-fat frozen food products as being healthy.  The products are actually unhealthy junk foods, the lawsuit states.

  

Burke and others in the class seek a jury trial, declaratory and injunctive relief, restitution and disgorgement, interests, actual and statutory damages, punitive damages, attorney fees and costs. They are represented by attorneys Thomas A. Canova and Jack Fitzgerald of The Law Office of Jack Fitzgerald in San Diego, and Paul K. Joseph of The Law Office of Paul K. Joseph, also in San Diego.
