Florida woman alleges EverQuote sent unsolicited messages

BOSTON (Legal Newsline) - A Florida woman is suing an auto insurance sales leads generator, alleging it sent unsolicited text messages to consumers' cell phones.

  

Yvonne Lester, individually and for all others similarly situated, filed a class action lawsuit April 1 in the U.S. District Court for the District of Massachusetts Boston Division against EverQuote Inc., formerly known as AdHarmonics Inc., alleging violation of the Telephone Consumer Protection Act.

  

The suit alleges EverQuote sent unsolicited text messages using automatic dialing equipment without the recipients' express written consent.

Lester and others in the class seek a jury trial, actual and statutory damages, declaratory and injunctive relief, disgorgement, attorney fees and costs. They are represented by attorneys Erica C. Mirabella of Mirabella LawLLC  in Boston, Rafey S. Balabanian of Edelson PC in San Francisco, and Stefan Coleman of the Law Offices of Stefan Coleman LLC in Miami.
