Customer accuses RelayRides of charging twice

SAN FRANCISCO (Legal Newsline) - A Chicago man is suing a car rental company, alleging it unlawfully charges customers twice.

  

Prov Krivoshey, individually and for all others similarly situated, filed a class action lawsuit March 31 in U.S. District Court for the Northern District of California against RelayRides Inc. doing business as Turo, alleging violations of California's Consumer Legal Remedies Act and other California civil and business codes.

  

The suit states the defendant charges "Admin. Fees" any time a customer breaches its service agreement.  The lawsuit states RelayRides charges customers twice, once for the purported damage customers may have caused and again as a penalty for having caused the damage. The complaint says these fees are a windfall for RelayRides.

  

Krivoshey and others in the class seek a jury trial, injunction, restitution, a constructive trust, damages according to proof, liquidated damages, interests, attorney fees and costs of the suit. They are represented by attorneys Scott A. Bursor, L. Timothy Fisher, Annick M. Persinger, and Yeremey Krivoshey of Bursor & Fisher in Walnut Creek, California.
