LOS ANGELES (Legal Newsline) – A California man is suing a caller ID services provider and its owners over claims they robo-called his cellphone without his consent.

Jason Alan, individually and for all others similarly situated, filed a class-action lawsuit March 16 in U.S. District Court for the Central District of California against CallerID4U, Paul Maduno and Luis Martinez, alleging negligent and willful violations of the Telephone Consumer Protection Act.

The suit states the defendants called Alan's cellphone without his consent using an automatic telephone dialing system to sell or solicit its business services. When Alan answered, he was allegedly rerouted to a third party that also used an automated database.

According to the suit, the defendants were acting as a dialer company that routed calls for a third-party telemarketer.  The suit states the defendants entered into revenue sharing agreements with telemarketers who make unsolicited telephone calls.

Alan and others in the class seek statutory damages of $500 per violating call and treble damages of $1,500 per violating call. They are represented by attorneys Todd M. Friedman and Adrian R. Bacon of the Law Offices of Todd M. Friedman in Beverly Hills, California.
