Boost Software settles with Florida and FTC over allegations of deceptive marketing

TALLAHASSEE, Fla. (Legal Newsline) – The office of Florida Attorney General Pam Bondi, in conjunction with the Federal Trade Commission, announced a $200,000 settlement with Boost Software over allegations the company deceptively marketed computer software and tech support services.

The complaint was filed against Boost Software Inc., Boost Software’s Principal Amit Mehta, Vast Tech Support LLC’s Principals Elliot Lowenstern and Jon-Paul Vasta, and related entities.

Boost Software sold PC HealthBoost through websites and pop-up ads. The product, according to the company’s claims, would dramatically increase computer speed and protect from errors, crashes and freezes. According to the state and FTC allegations, a free version of the software would notify consumers of problems their technology did not actually have, and urge them to purchase the $30 registered version of the product to fix the non-existent issues.

Boost Software agreed in the settlement to stop all future misrepresentations of material fact and upselling, selling leads or assisting in upselling or selling leads in connection with tech support products.

The defendants agreed to more than $200,000 in total judgments and suspended judgments of more than $37 million. Additionally, the defendants will surrender all assets of Jon Paul Holdings LLC and Success Capital LLC.
