BROOKLYN, N.Y. (Legal Newsline) – A New York woman is suing a food company over claims it misrepresents certain snap peas snacks.
Jutamat Riedel and John Does 1-100, individually and for all others similarly situated, filed a class-action lawsuit Jan. 15 in U.S. District Court for the Eastern District of New York against Calbee North America, alleging unjust enrichment, negligent misrepresentation, violations of New York's General Business Law and violations of consumer protection statutes in all 50 states and the District of Columbia.
The suit claims Calbee North America markets its Harvest Snaps food products as "simply baked snap peas," when in fact they are a combination of powdered snap peas, rice, and corn oil, among other ingredients and flavoring agents.
The suit claims Calbee North America's actions take wrongful advantage of consumers' preference for food made entirely of wholesome ingredients.
The plaintiffs and others in the class seek restitution and disgorgement, compensatory damages, actual and/or statutory damages, interests, and attorney fees and costs, together to exceed $5 million. They are represented by attorneys C.K. Lee and Anne Seelig of Lee Litigation Group in New York City.
