Crystal Clear, others sued over alleged antitrust violations

NASHVILLE, Tenn. (Legal Newsline) – Three Tennessee residents are suing a telecommunications company over claims it requires certain neighborhood residents to purchase its services.

Courtney Cates, Brian Stover and Jason Miller, individually and for all others similarly situated, filed a class-action lawsuit Jan. 5 in the U.S. District Court for the Middle District of Tennessee against Crystal Clear Technologies, et al., alleging unjust enrichment, violations of the Clayton Antitrust Act, violations of the Sherman Antitrust Act and violations of other federal and Tennessee state codes.

The plaintiffs own their own homes in the Thompson's Station, Tennessee neighborhoods of Bridgemore, Tollgate and Canterbury. These neighborhoods receive telecommunications from Crystal Clear, the complaint states.

The suit alleges Crystal Clear and the other defendants, the homeowners associations for the respective neighborhoods, unlawfully require residents of these neighborhoods to purchase telecommunications from Crystal Clear and that their actions violate federal antitrust and telecommunications laws.

The plaintiffs and others in the class seek monetary damages, attorney fees and costs of the suit. They are represented by attorneys J. Gerard Stranch and Benjamin A. Gastel of Branstetter Stranch & Jennings in Nashville.
