New York AG's Office enters assurance of discontinuance with Hush Day Spa over gift certificates

NEW YORK (Legal Newsline) – New York Attorney General Eric T. Schneiderman announced an assurance of discontinuance with Hush Day Spa.

Hush Day Spa LLC, located at 420 Southwestern Blvd. in Hamburg, went out of business in September. At the time of closing, it had $40,000 in outstanding gift certificates.

“It is critical that consumers are able to receive reimbursement for gift cards and services paid in advance when businesses are forced to close their doors,” Schneiderman said. “I encourage consumers to keep records of their purchases, and as always, to contact my office if they need assistance in these matters.”

Hush Day Spa opened in 2010 with a wide array of services but went out of business this year after a steady decline in business, according to its owner. Throughout its time in business, Hush Day Spa sold gift certificates ranging in value from $10 to $330. It did not keep record of who had bought certificates. Instead, the certificates were treated as bearer bonds. Anyone who presented a gift certificate would receive treatment.

Pursuant to the assurance of discontinuance, Hush Day Spa will offer refunds to those who file proper complaints by Feb. 5, 2016. Complaints can be filed by calling 716-853-8404.
