Proctor and Gamble facing lawsuit over one of its Pantene products

BROOKLYN, N.Y. (Legal Newsline) – A well-known beauty products company is facing a lawsuit over claims that one of its shampoos does not perform as advertised.

Plaintiff Suzanna Lee of Queens County, New York, together with Valerie Liu of Los Angeles County, California and John Does 1-100 brought suit on Nov. 18 in the U.S. District Court for the Eastern District of New York against The Procter & Gamble Co., citing violations of the New York Deceptive and Unfair Trade Practices Act, California's Consumer Legal Remedies Act, California's Unfair Competition Law, and California's False Advertising Law in addition to having made negligent misrepresentations, having breached their own express warranties, and having been unjustly enriched in so doing.

Plaintiffs claim they were induced to purchase defendant's Pantene Pro-V Expert Collection Advanced Keratin Repair shampoo and conditioner as a result of the advertising and promotional claims on the product website, labels and related marketing materials distributed nationwide. They further allege the products were presented as capable of repairing and restoring damaged hair in a single wash or a few minutes as well as "fighting" damage and that these claims were untrue and deceptive. Plaintiffs claim that they were harmed in that they paid a premium for these products because of these deceptive claims.

Plaintiffs on behalf of themselves and the entire class of similarly affected individuals seek damages of more than $5,000,000, in addition to costs, and seek a trial by jury. They are represented by attorney C.K. Lee, Esquire of Lee Litigation Group, PLLC located in New York, New York.
