Columbia Sportswear faces lawsuit over price manipulation allegations

SAN FRANCISCO (Legal Newsline) – Two Oakland residents are suing Columbia Sportswear over claims of false pricing.

Jeanne and Nicolas Stathakos, on behalf of themselves and others similarly situated, has filed a class action lawsuit on Oct. 2 in the U.S. District Court for the Northern District of California against Columbia Sportswear Co., citing violations of consumer and business laws.

According to the lawsuit, on July 26, the plaintiffs entered the Columbia Outlet store in Vacaville, Calif. They observed merchandise that was advertised with price tags denoting “former price” and the sales sticker price, which represented a significant savings. They allegedly purchased several items with the former price and sales price tag, enticed by their savings. However, upon research, the plaintiffs discovered that the “former price” listings were allegedly overstated and did not represent a bona fide price at which the Columbia Outlet products were previously sold, the complaint states. They claim the defendants also allegedly sell certain goods manufactured exclusively for their outlet stores, which meant that there were no “former price” tags for said products. The plaintiffs argue that the defendants inflated and/or lied about their former prices to deceive costumers into purchasing their products.

They are suing demanding a trial by jury and are suing for restitution and/or equitable relief, enjoining defendants from unlawful and deceptive business practices, attorney and court costs, and any other relief as deemed appropriate by the court.
