MacPro faces lawsuit over phone spamming claims

SANTA ANA, Calif. (Legal Newsline) - A California woman is suing a business over claims of telephone spamming.

Lynne Holley of Lake Forrest, on behalf of herself and those similarly situated, filed a class action lawsuit on Oct. 7 in the U.S. District Court for the Central District of California, Southern Division against Mac Pros Sales and Installation Inc., doing business as MacPro Inc., and John Does 1 through 20, citing violations of the Telephone Consumer Protection Act (TCPA).

Holley claims that on or around the afternoon of May 5, the defendant contacted her telephone number in an attempt to advertise a search engine optimization service.

Holley alleges that MacPro used an automated telephone dialing system as a means to place calls to her and others like her. Holley incurred charges for those calls. She also alleges that she never gave prior express consent to defendants, therefore the defendants have violated the TCPA.

Holley is suing for $500 for each and every violation of the TCPA, $1,500 in statutory damages for willful violation of the TCPA, an injunction to the defendant to prevent them from engaging in any further unlawful acts, and attorney and court fees and any other relief that the court deems proper. She is seeking a trial by jury and is being represented by John P. Kristensen and David Weisberg of Kristensen Wesiberg LLP in Los Angeles.
