Honest Co. sued over allegations of misleading advertising

SAN FRANCISCO (Legal Newsline) - A Los Angeles man is suing a manufacturer of natural products, claiming their all natural claims are misleading.

Plaintiff Jonathan D. Rubin, on behalf of himself and those similarly situated, filed a class action lawsuit on Sept. 3 in the California Northern District Court, San Francisco Division against The Honest Co. Inc., citing breach of contract, violations of the California Consumer Legal Remedies Act and California False Advertising Law, unjust enrichment and violations of the California Business and Professions code.

According to the complaint, the Honest Co. has been advertising and continuing to market its products as “all natural” since Sept. 20, 2012. Rubin argues that the several of the products produced by defendants, such as Honest Hand Soap, Honest Dish Soap, Honest Diapers, Honest Multi-Surface Cleaner, and Honest Sunscreen (collectively referred a products) are, allegedly, not natural and contains unnatural ingredients such as phenoxyethanol, methylisothiazolinone, and sodium polycrylate. Rubin also argues that the sunscreen is ineffective at preventing harmful UV rays from penetrating the skin.

The plaintiff is suing for damages of at least $5 million, an injunction for defendants to stop its campaign and engage in corrective marketing, restitution for another $5 million, court costs and attorney fees. He is requesting a jury trial and is being represented by attorney Nicolas A. Carlin and Conor H. Kennedy of the offices of Phillips, Erlewine, Given & Carlin LLP in San Francisco.
