Uber, the popular taxi-like service, is being sued for allegedly making text messages to customers’ cell phones.

Alexios Kafatos filed the lawsuit Aug. 14 in United States District Court in California against the large online-based transportation company. The company provides rides to customers via its smartphone app.

The lawsuit claims Uber would send the advertisement text messages to customers, which violated the federal Telephone Consumer Protection Act. Further, the lawsuit claims the text messages invaded customers’ privacy.

Kafatos said he had never visited Uber’s website or conducted business with the company when he received at least two text messages in July and August. The lawsuit said the text messages were sent via an automatic telephone dialing system, which it contends is illegal under federal law.

The lawsuit is seeking class status for those who received a cell phone call from Uber. Kafatos is also seeking $1,500 for each call made by Uber, and is seeking damages in excess of $5 million plus court costs.

Kafatos is represented by Todd M. Friedman, Adrian R. Bacon, Suren N. Weerasuriya of the Law Offices of Todd M. Friedman, P.C. in Beverly Hills.
